| LIMITED ONE, THREE, FIVE And LIFETIME WARRANTEES | |
| For a period of 12, 36 or 60 months (depending on service level purchased) from the date the work described on the front of this [your] proposal is completed, Evans Brothers will repair any newly applied paint which may peel or blister as a result of a defect in workmanship free of any labor charge. Lifetime warranty applies to only interior painting and includes a service evaluation after 24 Months from completion. | |
| WARRANTY LIMITATIONS: | |
| • The cost of paint required to perform
the repairs are not covered by this warranty. • Any work where Evans Brothers did not supply paint or other materials is not covered by this warranty. • Any work not performed by Evans Brothers is not covered by this warranty. • Repairs will only be performed to the level of preparation described in the proposal. • Varnished surfaces or surfaces made of, or containing, galvanized metal are not covered by this warranty. • Horizontal surfaces or any surface that permits moisture to collect. Such surfaces include but not limited to decks, railings, stairs, porches, floors, etc. • Repairs will be performed only on the specific areas where peeling and/or blistering has occurred, Exact color match is not warranted due to the possibility of fading. • Peeling or blistering which results from a defect in the paint applied is not covered by this warranty regardless of whether supplied by Evans Brothers or the customer. For details on warranties applicable to the paint, please consult the label on paint manufacturer's paint product. |

| CUSTOMER'S RESPONSIBILITIES: | |
| For this warranty to be effective, you
must: • Pay the full contract price. • Retain a copy of the original contract. • Retain a copy of your cancelled check or other evidence of payment in full. • Pay for all materials, and or equipment used to perform the repairs. • Make the property reasonably accessible to Evans Brothers and it's employees. |

| THIS LIMITED WARRANTY IS THE ONLY EXPRESS
WARRANTY MADE BY Evans Brothers AND IS IN LIEU OF
ALL OTHER WARRANTEES, EXPRESS OR IMPLIED. THIS WARRANTY IS APPLICABLE ONLY
TO PAINTING SERVICES PROVIDED TO THE ORIGINAL PURCHASER WHO IS IDENTIFIED
ON THE FRONT COVER OF THIS CONTRACT, Evans Brothers
SHALL NOT BE FOR MATERIALS, WORKMANSHIP OR BREACH OF THIS WARRANTY, NOR
SHALL Evans Brothers BE LIABLE FOR ANY INCIDENTAL
OR CONSEQUENTIAL DAMAGES OR DAMAGES IN EXCESS OF THE ORIGINAL CONTRACT PRICE.
AT NO TIME MAY THIS WARRANTY BE ALTERED OR EXTENDED FOR ANY PURPOSE. |

rights, Some states do not allow limitations on how long an implied warranty
lasts, so the above limitation may not apply to you, Some states do not
allow the exclusion or limitation of incidental or consequential damages,
